Havfisk wins the appeal over case for vessel and quota
(NORWAY, 8/16/2016)
Havfisk ASA announced it has won the appeal submitted in the Court of Appeals in Hålogaland Lagmannsrett by Hermes AS, regarding an agreement to sell a vessel and quotas.
The case is connected to the agreement settled to sell the vessel Jergul and 1.35 quota units of cod and haddock.
Havfisk recalls that on April 15, 2015 it received a summons from Hermes AS with claim for compensation for alleged losses limited upwards to NOK 150 million (USD 18 million).
The claim involved the lack of fulfillment of the contract and compensation for default of the contract.
Havfisk won the case heard in Nord-Troms District Court in November last year. According to the judgement that fell on December 11 in the same year. Havfisk was acquitted for the entire claim, and was awarded legal costs.
However, on January 21 this year Hermes AS appealed the judgement by the District Court to Hålogaland Lagmannsrett, with claim for compensation for alleged losses limited upwards to NOK 110 million.
The proceedings took place from June 6 to 10 this year and the judgement fell on August 16 with the rejection of the appeal, acquitting Havfisk for the claim.
