Havfisk wins lawsuit brought by Hermes AS

Havfisk ASA won the lawsuit brought by Hermes AS regarding an agreement to sell a vessel that included quotas of certain resources.
In this regard, Havfisk refers to earlier notifications of 3 July and 11 December 2013 and statements in interim- and annual reports regarding the agreement to sell a vessel and quotas.
On 15 April 2015 Havfisk received a summons from Hermes AS with claim for compensation for alleged losses limited upwards to NOK 150,328,200 (USD 17.3 million). The claim involved lack of fulfillment of the contract, and compensation for default of the contract.
The sale included 1.35 quota units of cod and haddock, 1.38 quota units of saithe north of the 62 parallel and 1.0 quota unit for fishing saithe south of the 62 parallel.
The vessel Jergul was also included in the sale. The agreement was planned to be concluded in 2014 and was subject to approval from Norwegian authorities.
The agreement expired on 1 July 2014 as the approval from the authorities had not yet been received. Later, the authorities concluded with a refusal of the transaction.
Havfisk won the case heard in Nord-Troms District Court in November 2015.
The judgement fell at 11 December 2015 and concluded that Havfisk is acquitted for the entire claim, and is awarded legal costs.
