Preliminary Results (POR20) of Anti-Dumping Duty on Pangasius Fillets to the US: Many Exporters Exempt from Taxes

The U.S. Department of Commerce (DOC) has initiated the administrative review of the anti-dumping duty on frozen pangasius fillets from Vietnam for the review period from August 1, 2022, to July 31, 2023 (POR20), according to the Vietnam Association of Seafood Exporters and Producers (VASEP).

In the preliminary results of POR20, the DOC determined that several Vietnamese exporters, including prominent companies like Bien Dong and Vinh Hoan, did not engage in dumping practices in the U.S. market. As a result, these companies will not be subject to anti-dumping duties. In total, eight companies are eligible for separate tax rates, including Vinh Hoan Corporation, Bien Dong Seafood, Can Tho Seafood Import-Export Joint Stock Company (CASEAMEX), Dai Thanh Seafood, Dong A Seafood, Hung Ca 6, Nam Viet Joint Stock Company (NAVICO), and NTSF Seafood Joint Stock Company (NTSF SEAFOODS).

Because the U.S. considers Vietnam a non-market economy, the DOC uses surrogate values from third countries to determine dumping margins. For this review, Indonesia was chosen as the surrogate country, given that: 1) Indonesia has a comparable economy to Vietnam, 2) it produces goods similar to those under investigation during the review period, and 3) it provides reliable data that allows the DOC to assess Vietnam's production factors accurately.

The DOC is expected to announce the final anti-dumping duty results within 120 days of releasing the preliminary findings.
