NOAA Proposes Commercial Spearfishing for Tuna and Fishing Gear Modernization in the U.S. Caribbean

The National Oceanic and Atmospheric Administration advances a regulatory revision to optimize highly migratory species operations in the Atlantic, benefiting commercial fishermen in the U.S. Virgin Islands and Puerto Rico.

The National Oceanic and Atmospheric Administration (NOAA Fisheries) has presented a proposed rule aimed at revising commercial fishing gear regulations for highly migratory species across the northwestern Atlantic Ocean, the Gulf of Mexico, and the U.S. Caribbean. The measure, officially issued on August 13, 2026, seeks to modernize operational regulations and provide greater flexibility to authorized commercial fishermen in the region.

Among the key highlights of the proposal is the authorization for holders of the Commercial Caribbean Small Boat permit to harvest and commercially sell four tuna species using spearguns (spearguns). The species included in this group, designated as BAYS, are yellowfin tuna (Thunnus albacares), bigeye tuna (Thunnus obesus), albacore tuna (Thunnus alalunga), and skipjack tuna (Katsuwonus pelamis).

Spearfishing Conditions and Conservation

The proposed regulation by NOAA establishes strict technical criteria for the use of spearguns in commercial tuna harvesting:

  • Commercial fishermen must be physically in the water when firing the equipment, with freediving, autonomous diving (SCUBA), or any other underwater breathing apparatus permitted.

  • Only free-swimming specimens may be taken. Shooting fish that have been previously restrained on fishing lines remains strictly prohibited.

  • The total prohibition on the use of explosive heads (powerheads) and any other detonating devices remains in place.

  • The commercial spearfishing authorization does not extend to swordfish (Xiphias gladius), bluefin tuna (Thunnus thynnus), or shark species.

Modernization of Buoy Gear and Bait Collection

The NOAA Fisheries plan addresses the technological updating of existing gear types. Holders of the Commercial Caribbean Small Boat permit, who are authorized to deploy up to 35 buoy gears (buoy gear), will be allowed to use power assistance—such as electric or hydraulic winches—for retrieving and deploying gear, eliminating the previous requirement for exclusively manual handling.

According to the economic analysis conducted by NOAA, the implementation of electric reels carries an estimated cost of US$ 8,000, while a hydraulic setup approaches US$ 2,000. This modernization aims to optimize operational efficiency during deep-water fishing operations and reduce physical fatigue among crew members. Additionally, the proposal allows these fishermen to retain allowable shark species caught incidentally on buoy gear, utilizing commercial quotas that have historically remained underutilized.

Furthermore, the rule clarifies that vessels engaged in highly migratory species fisheries may carry and operate cast nets (cast nets) and small dipnets (dipnets) intended exclusively for live bait collection, correcting a technical omission in previous regulations.

The public consultation process for this federal proposal includes two webinars held on August 31, 2026, and October 1, 2026, with the public comment period remaining open until October 13, 2026.
