The excellent interview (11/24/2022) of the journalist from the Puerto Magazine Karina Fernández to the Minister of Production and Environment of Tierra del Fuego Sonia Elizabeth Castiglioni is eloquent enough and, speaks for itself, of the disabilities that some officials have when, both at the national level and in the Argentine provinces, they occupy relevant positions without having sufficient aptitude to design a comprehensive strategy and, many more, when their domestic decisions could affect national sovereignty and the sustainability of the marine ecosystem, harming sustainability of national production and the perpetuity of third generation fishing species.

Such is the case of the aforementioned Castiglioni, who does not register a single private record in the production of goods or any enabling title in matters of environmental development and sustainability, but has limited her activity to carrying out some private tasks related to computer and administrative systems. and lives in the municipal state of Río Grande and the Fuegian province from April 1994 to date; she being her since this month, in addition to minister, titular director of YPF S.A. (?). This lady must have some virtue to access such positions without having a relevant background and, from her answers given to the astute journalist, she does not seem to exhibit political and strategic clarity or knowledge of current legislation, in the face of the responsibility that falls to her, having Keep in mind that it is a secretary of the Governor in matters of production and care of the environment of the southernmost province, which has under its jurisdiction -no less- than the Falkland-Malvinas, the rest of the island territories, Antarctica and the corresponding waters ; For this reason, her actions and statements may violate the national interest or hinder the laborious Argentine diplomatic relations with the United Kingdom, in addition to seriously harming the national production and work that exploits Argentina's fishing resources.

The position exhibited by the minister in her answers goes against the opinions of all forums of multilateral organizations and international and national experts regarding the devastating effects of Illegal Fishing and the capture of migratory resources originating in the Exclusive Economic Zone (ZEE), by foreign vessels that, in a subsidized manner, fish in the Argentine Southwestern Atlantic. And, in Illegal Fishing there are not only economic, biological, environmental and social damages, but these practices cause violations in terms of slave labor and drug trafficking, in addition to undermining the sovereignty of the coastal States. Therefore, this official cannot balance all this and contrast it with the unfounded intention of generating some economic resources for the province provided by predatory fishing boats that, moreover, will not have any size in relation to the 1,080,000 tons of species migratory originating from the Argentine ZEE that annually extract Chinese, Spanish, British, Korean, Taiwanese, etc. for an FOB value of 4,320 million U$S and 24,000 million U$S in the final market (Mercado Central de Valencia, 11/22), to which are added 325,000 tons of fishing resources that are extracted annually in the Falkland-Malvinas area with British illegal licences, for a value of 1.5 billion US$ FOB which, in the final trade, becomes about 9 billion per year. A political and economic irresponsibility.

Karina Fernández says: "Sonia Castiglione spoke to this media about the construction of the multipurpose port in Río Grande and the intention to supply the fleet that operates in the South Atlantic and her interest in increasing the number of jiggers at sea Argentine" and, the journalist refers, that it would be "an investment of 210 million dollars from the Argentine firm Mirgor SACIFIA, whose main shareholder is the businessman Nicolás Caputo...". If it were an uninformed resident of the impenetrable Chaco, the opinion maker could accept such an insult to intelligence; but no, it is a Minister of the Environment who seems to ignore the ecological damage caused by illegal exploitation in the Falkland-Malvinas and the Southwestern Atlantic and the logistical support given to the Spanish-British, Korean and Taiwanese fleet both on the islands , as in Uruguay and Chile (plus the Chinese that fishes in the region) and has no better idea than to multiply the damage by also giving it logistical support in Rio Grande. Additionally, we believe that the inhabitants of this city should be very concerned about the negative side effects that the presence of these predators will cause.

She says the above that she "sees the services pass" to ships that operate illegally. Well, instead of watching them go by, she should act, because Falkland-Malvinas, the corresponding waters and their resources are part of the Province of Tierra del Fuego. In addition to the fact that her initiative would violate the Transitory Provision of the National Constitution, it would be necessary to wonder if the minister would not be failing in her duties as a public official when she does not sanction or denounce before the National Executive Power and the Federal Fisheries Council - where she has a provincial representative - The lack of sanctions to the vessels that fish in the marine area of ​​the Fuegian and Argentine Malvinas territory by application of Laws 24,922, 26,386 and 27,564 and articles 2; 25th; 31st inc. 4; 49th; 53 inc. 5; 54th; 58th Inc. 7 and 11; 63rd; 68º and 79º of the Constitution of Tierra del Fuego and especially Article 81º (Natural Resources) which states: «Airspace, natural resources, superficial and underlying, renewable and non-renewable sources and contents in the adjacent sea and its bed, extending its jurisdiction in matters of economic exploitation to where the Republic exercises its jurisdiction, including those that to date have been administered and regulated by the National State..." and article 87 ( Fishing) "Within the maritime areas of provincial jurisdiction and water courses or mirrors, the Provincial State preserves, regulates and promotes its hydrobiological resources (...) Schools of migratory marine species are property of the Province, and will be subject to to a special protection regime" and, also, by application of Provincial Fishing Law 244 (8/17/1995) which in its article 1 indicates: "The prescriptions es of this Law shall apply to existing hydrobiological resources in inland and maritime waters considered domain and provincial jurisdiction as defined in article 124 of the National Constitution and article 81 of the Constitution of the Province (...) with the provisions of article 87 of the same, in relation to resources of a migratory nature" and the provisions of articles 6, 12 to 18 and 41 to 50 of the aforementioned law. Contraband is not denounced for non-payment of customs duties (Law 22,415) on extractions and subsequent imports, mostly in Spain, of catches in the Malvinas area.

By the way, an initiative of this nature would require a previous Agreement ratified by the National Congress by rule of articles 4; 5 d; 21ºe, 22º and 37º of Law 24,922 and the prohibition derived from Article 27º bis of this law.

The natural resources of the Province and those of the Nation are being plundered by foreign vessels and, the Minister, wishes to give logistical facilities to these vessels, while stating: "There are things that they do not see from Buenos Aires" and this -although somewhat demagogic - it is very probable, but, in this case, blindness is within the scope of his responsibilities.

 "A job opportunity" she indicates; but what will cause this absurd proposal to give logistical support to the fleet that fishes at distance in "mile 201" will be an increase in the number of foreign vessels in the Southwestern Atlantic and the fishing effort, causing very serious damage to the ecosystem , the fall in the catches of the companies that are based in Argentina and the consequent loss of national work and, in the case, of facilitating the operations of the vessels that fish in the Falkland-Malvinas (the The minister refers to the services provided in the Malvinas and Chile), it will give greater sustainability to these companies, consolidating the British presence on the islands.

It is very likely that the minister does not know how to generate work in the maritime, port and fishing fields. Fishing landings in Tierra del Fuego fell by 50% from 2005 (90,472 tons) and 2021 (49,645 tons); In addition, the Province lacks processing industries on land and added value, which significantly reduces the employment of labor. The minister has been unable to generate employment in this area during her administration in Río Grande and the Province.

The lack of knowledge that Sonia Elizabeth has about the productive aspects of the activity and, especially, about the provincial legislation that refers to migratory resources, resources that are the ones that a large part of the foreign fishing fleet fishes on the high seas and, refers to, is notable, to that "at mile 201 they catch what we don't catch", which is absolutely inaccurate, because the species are the same, migratory and/or associated and, forgetting to say that the fleet of the flag States that fishes at a distance subsidized operation; without the payment of rights and/or tariffs of capture and/or import and/or export with total disregard for the labor and security laws that tax Argentine employment.

She also indicates that "Whether it is legal or illegal fishing will be parameters that we must clearly establish" and, we must remind her that there is nothing to establish; the entire foreign fleet that operates in the Southwestern Atlantic does so illegally due to non-compliance with two basic parameters: it does not have control of the flag State and has not signed an agreement with the coastal State and, for 40 more reasons that derive from this and that I omit so as not to bore. In the case of Falkland-Malvinas, the violation of United Nations Res. 31/49 is added.

Finally, their arguments regarding the port of choice for the foreign fleet are so naive and incompetent in the matter and Argentine incapacities in terms of control, and they also ignore what the Chinese presence in the region could mean. facilitating transit to the Pacific and illegal fishing in both oceans and operations in the Antarctic.

And in the imaginary that these great predatory fishing superpowers with their 500 or more annual vessels decide to take their catches to the Rio Grande or another nearby port, who is supposed to control the catches and the transit of the fleet from the high seas to the port and who would control the origin, discards, raw materials in chambers, the working conditions of the personnel on board, etc. Such an initiative requires a much greater effort than obtaining an investment to build a port that, with this model, will definitively consolidate the foreignization of the Southwestern Atlantic.

"Jiggers charter?" To talk about it, Sonia Elizabeth should previously know something about the fishing history; then, to know the shareholding composition of the current fleet authorized to fish in the national jurisdiction and, thirdly, to work together with the Chamber of Argentine Jiggers Owners (C.A.P.A) that is questioning the actions that it favors.
