COFEPRIS is a decentralized body with administrative, technical and operational (Article 17 bis 1) and in front of it is a Federal Commissioner appointed by the President of the Republic on the recommendation of the Secretary of Health, being the Secretary of Health who oversees the COFEPRIS (Article 17 bis 2).
Under the General Law of Health, the Ministry of Health shall exercise the powers of regulation, control and health promotion, through the Federal Commission for Protection against Health Risks regarding (Art. 17 a):
The control and monitoring of health facilities.
Prevention and control of the harmful effects of environmental factors on human health.
